Welcome to Evolting! These Terms and Conditions (hereinafter: “Terms”) apply to the use of the website and services of Evolting, an online marketplace for electric vehicles. By using Evolting you agree to these Terms.

• Evolting: the trade name of Evolting, established at Schoolstraat 33.
• User: Any visitor to the website and any person or entity who creates an account and/or places advertisements.
• Buyer/Seller: Parties involved in the purchase and sale of electric vehicles via Evolting.

2. Services of Evolting

Evolting provides a platform where Users can buy and sell electric vehicles. Evolting is not a party to the sales agreement between Buyer and Seller, and cannot be held responsible for any failure of either party.

3. Use of the Platform

• Users must register to advertise vehicles and respond to advertisements.
• Users must provide accurate and complete information. Incorrect information may result in termination of the service.
• Misuse of the platform (such as posting false information or fraudulent offers) is not permitted and may result in immediate account termination.

4. Payment and Reimbursement

• Evolting offers various advertising packages, with rates as stated on the website. These costs are charged when placing advertisements.
• All payments must be made as stated when ordering the package. Payments are non-refundable unless otherwise stated.

5. Liability

• Evolting cannot be held liable for any direct or indirect damage resulting from the use of the platform, including damage due to transactions between Buyer and Seller.
• Evolting makes no guarantees about the completeness, accuracy, or quality of the vehicles offered.
• Users should conduct their own research into the quality and legality of the vehicles.

6. Privacy

For the use of personal data, we refer to our [Privacy Statement]. Evolting respects your privacy and only processes personal data in accordance with the GDPR.

7. Intellectual Property Rights

All content and materials on Evolting, including text, logos, and images, are property of Evolting or its licensors. Users may not copy, reproduce, or distribute these materials without prior written permission.

Evolting reserves the right to change these Terms at any time. Users will be informed of this, and by continuing to use the platform they agree to the changed Terms.

9. Applicable Law and Disputes

These Terms and Conditions are governed by Dutch law. Any disputes will be submitted to the competent court in the district where Evolting is established.
